End-User License Agreement (EULA) of Touch Paradise XXX Game Titles (All)
This End-User License Agreement ("EULA") is a legal agreement between you and Shadow Arts Limited.
This End-User License Agreement covers all game titles developed by Shadow Arts Limited, and which fall under the Touch Paradise XXX umbrella. These game titles include (but are not limited to):
- Touch Paradise XXX Rewind Demo
This EULA governs all Touch Paradise XXX titles irrespective of their platforms.
This EULA agreement governs your acquisition and use of our Touch Paradise XXX Game Titles (All) software ("Software") directly from Shadow Arts Limited or indirectly through a Shadow Arts Limited authorized reseller or distributor (a "Reseller").
Please read this EULA agreement carefully before completing the installation process and using the Touch Paradise XXX Game Titles (All) software. It provides a license to use the Touch Paradise XXX Game Titles (All) software and contains warranty information and liability disclaimers.
If you register for a free trial of the Touch Paradise XXX Game Titles (All) software, this EULA agreement will also govern that trial. By clicking "accept" or installing and/or using the Touch Paradise XXX Game Titles (All) software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.
This EULA agreement shall apply only to the Software supplied by Shadow Arts Limited herewith regardless of whether other software is referred to or described herein. The terms also apply to any Shadow Arts Limited updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.
License Grant
Shadow Arts Limited hereby grants you a personal, non-transferable, non-exclusive licence to use the Touch Paradise XXX Game Titles (All) software on your devices in accordance with the terms of this EULA agreement.
You are permitted to load the Touch Paradise XXX Game Titles (All) software (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the Touch Paradise XXX Game Titles (All) software.
Age Warning
All Touch Paradise XXX game titles and applications contain sexually explicit content. What this means is that they are unsuitable for persons below the age of 18 (21 in some countries). They are strictly intended for a mature audience only.
If you download and install any of the Touch Paradise XXX game titles (irrespective of the platform), you agree that you are over the age of 18 (21 in some countries), and can legally access such content in your country/region without breaking the law.
If you do not meet the minimum age requirements to access and interact with sexually explicit content in your country/region, then please do not download, install, and interact with any of the Touch Paradise XXX titles and applications.
If you do not meet the minimum age requirements to access and interact with sexually explicit content in your country/region, and you have encountered any of the Touch Paradise XXX titles on any of your devices, then please uninstall the application in question immediately and delete all associated installation files from your devices.
Following the various notices and warnings, Shadow Arts Limited will not be held liable for anyone who accesses any of the Touch Paradise XXX titles and applications, and who does not meet the minimum age requirements to access and interact with adult content in their respective countries/regions.
Demonstration (Demo) Applications
All Touch Paradise XXX Demonstration Game titles are thoroughly bug tested prior to release, and due to differences in device architectures, it is possible that you might encounter a feature that might not work as intended. These demonstrations are a 'BETA', and are subject to frequent changes. Please free to report this using the 'technical' section of the official website. Shadow Arts Limited will not be held liable for any damages that may occur to your device as a result of downloading, installing, and making use of any of the Touch Paradise XXX game titles.
You are not permitted to:
- Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things.
- Reproduce, copy, distribute, resell or otherwise use the Software for any commercial purpose.
- Allow any third party to use the Software on behalf of or for the benefit of any third party.
- Use the Software in any way which breaches any applicable local, national or international law.
- Use the Software for any purpose that Shadow Arts Limited considers is a breach of this EULA agreement
Intellectual Property and Ownership
Shadow Arts Limited shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of Shadow Arts Limited.
Shadow Arts Limited reserves the right to grant licences to use the Software to third parties.
All models/people depicted in all Touch paradise XXX Game titles are compliant with the 18 U.S. Code § 2257 - Record keeping requirements and are all over the age of 18. All media used for the production and development of all Touch Paradise XXX titles fall under the following categories: - Public Domain (CC0). - Original/created by Shadow Arts Limited who retain full ownership.
- Licensed: Content that is under a distribution license. Such content could be purchased, and Shadow Arts Limited has the permission to include such works in the production of application.
Termination
This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to Shadow Arts Limited.
It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.
Governing Law
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of gb.
